Municipal Bye Laws of 2011 in chaper-3, S.N0.13, section (a) reads as “JDA/JMC not get NOC from allied departments within the period of three weeks it shall be presumed that the concerned agency has no objection to the erection or re erection of the building at proposed site”. If Govt is not interested then these Bye Laws be cancelled as being not followed.

Interestingly S.No.15,(a) reads as “The authority shall communicate the decision within 60 days” & (b) reads as “If the authority fails to communicate within stipulated period, the plan shall be DEEMED TO HAVE BEEN SANCTIONED” but these guidelines can be understood by technicals & strange story of JDA is that Senior Town Planner is heading non technical team . who has to decide the fate of a technical structure.
One plan on Birpur road was put online vide submit No.209 dated 30.05.2013 but by this way or other every time new conditions were thrown on applicant despite the fact that in the same Khasra No. JDA is constructing a Housing Colony & mix land use is as per Master Plan.
It is pertinent to mention that big bosses of JDA sanctioned big plans on same road nearby including big illegal structures without sanction. The same STP section had sanctioned big plans in Agriculture land in nearby area. Details of which shall follow to show the clear faces of such officers.
It is strange to write that intelligent STP,JDA Mr. Raina who has been given additional charge of CTP,Town Planning Org. Jammu communicated to applicant in violation of on line system vide No.CTP/JDA/BPC/102 dated.24.12.2016 after the applicant fired an application for deemed sanction of plan on 19.12.2016. If applicant has to go office to office, what for on line system is? Is an eye wash?
The contents of the letter are as “You are advised to obtain NOC from AC(R)Samba at you earliest & furnish the same to this office” It speaks the intelligence of STP,JDA. It is matter of concern to see that already residential plan has been sanctioned on the same site/size/same Khasra No. of plot with all NOC,s. The applicant is requesting for commercial sanction on 4500 sft. Whereas as JDA has permitted big structures opposite to her plot & nearby without sanctions is a matter of concern.
It is pertinent to mention here that in para. 37 & 38 of the same case in UTEIC file DLM & Tehsildar, JDA have specifically cleared the tile of said piece of land of IK-19 M of land & what for Mr. Raina, STP, JDA again& again searching for ACR,NOC speaks of his vested considerations.
