DB dismiss LPA for default filed by JKUT itself for non appearance: Order sent to Secretary Law?


Jammu, November 21: After hearing LPA No. 3/2020 CM Nos. 61 & 62/2020) (Through Video Conferencing) State of J&K and others … Honble Chief Justice(on Video Conference from High Court at Jammu) Honble Justice Sindhu Sharma, JUDGE (on Video Conference from High Court at Jammu) on 20.11.2020ordered as:-

           "None appears for the appellant when the matter is called out. This appeal is dismissed for default of appearance.

Registry shall ensure that the copies of final orders passed in the matters where the State authority is party are sent to Secretary, Department of Law, Justice and Parliamentary Affairs, UT of Jammu and Kashmir and concerned Departments.

Now, a question had arised on the part of competant JKUT bosses that they themselves filed the LPA but stands dismissed for non appearanceof their counsel.

Why not Govt should recover the Govt money spent over the case till date from the personal pockets of the concerned, who soever caused its dismissal with some punishment, so that such kind of episodes may not occuer in near future for early justice.
