J&K Govt cancels appointment of Engineer over Fake RBA Certificate

Jammu, Oct 15: The Jammu and Kashmir Government has cancelled the appointment of a Junior Engineer in the Jal Shakti Department after revenue authorities found that the Reserved Backward Area (RBA) certificate submitted by him had not been issued by the competent authority.

Order copy with CTN read that "The appointment of Tabrez Mir, son of Mushtaq Ahmad Mir and a resident of Sogam, Chadoora, in Budgam district, has been cancelled ab initio, meaning it is treated as invalid from the beginning".

Mir was appointed as a Junior Engineer (Civil) under the RBA category through Government Order No. 82-JK(JSD) of 2026, dated April 30. He joined the department on May 2 and was subsequently posted to the Irrigation Division, Ompora, in June.

The appointment was subject to verification of the original certificates and documents submitted by him, including his reserved category certificate.

The order states that the department had forwarded his RBA Certificate No. JK-REV-SRE/2023/20647, dated November 16, 2023, to the Deputy Commissioner, Budgam, on June 3 for verification.

The Additional Deputy Commissioner, Budgam, subsequently informed the department on August 28, citing a report from the Tehsildar, Chadoora, that the certificate had not been issued by the latter’s office.

The verification findings established that the certificate was fake or forged, triggering the cancellation condition incorporated in Mir’s appointment order, the government order states.

The government cancelled the appointment under Section 16 of the Jammu and Kashmir General Clauses Act, Samvat 1977, read with Section 22(a) and (b) of the Jammu and Kashmir Reservation Act, 2004, and the relevant condition in the original appointment order.
