Srinagar, Sep 22 : The Central Administrative Tribunal Srinagar held that contractual employees also have a right of being heard before terminating his or her services.
DB held that contractual employees also could not be disengaged from the services without following the rules of natural justice & allowed the plea of one Pardeep Singh Bali with the direction to the authorities to explore the possibility of engaging him on any stop-gap arrangement in any scheme of the department by giving him some honorarium, so that he can make his both ends meet, however, subject to his eligibility.
Tribunal disagreed with the argument that for a contractual employee, no rules or procedure are required to be followed before disengaging him or her. However, it held that it is rather a settled position of law that even in the case of contractual employees, the rules of natural justice are to be followed to the hilt.
