JAMMU, July 21: Jammu and Kashmir Government imposed penalty on Engineer upon Er. Ghulam Hassan Rather, of "Premature retirement on proportionate pension other than that specified in Article 226(2) of J&K Civil Service Regulations" in terms of Rule 30(vi) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956" and disciplinary proceedings initiated against him stand finalized accordingly.
The Order copy with Cross Town News reads "WHEREAS, Er. Ghulam Hassan Rather, the then Assistant Executive Engineer, R&B Special Sub-Division, Uri was caught red-handed by the Anti-Corruption, Bureau, J&K while demanding and accepting bribe from a contractor and a case FIR No. 29/2022 was registered in P/S ACB, Baramulla; AND WHEREAS, as a sequel, vide Government Order No. 410- PW(R&B) of 2022 dated 22.11.2022, the officer was placed under suspension with effect from the day of his arrest i.e 17.11.2022 and was attached with the office of the Chief Engineer PW(R&B), Kashmir; AND WHEREAS, the General Administration Department vide Government Order No. 38-JK-GAD(Vig) of 2023 dated 07.07.2023 accorded sanction of his prosecution and recommended for consideration of the matter in terms of the Rule-31 of the J&K Civil Service (CC&A) Rules, 1956, for initiating consequential action against the accused public servant in terms of extant rules and circular instructions issued thereunder;
AND WHEREAS, after examining the matter, the General Administration Department was requested to furnish the copies of draft articles of charge/ statement of imputations etc, so that simultaneous departmental proceedings are initiated against the delinquent Engineer and in response the General Administration Department shared the copy of the final investigation report of the matter furnished by the ACB, J&K with the advice to frame the charges accordingly, to be served upon the delinquent Engineer in termis of the provisions of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956;
AND WHEREAS, Memorandum consisting of Article of Charges and Statement of Imputation was served upon accused through the Chief Engineer, PW (R&B) Department, Kashmir vide letter No. PWD- HRM1/97/2022-05 dated 18.10.2023 and in response the Chief Engineer, PW (R&B) Department, Kashmir shared statement of defense submitted by the delinquent officer, which was carefully examined and accused was not found satisfactory; AND WHEREAS, vide Government Order No. 524-PW(R&B) of 2023 dated 26.12.2023, Er. Narinder Kumar, the then Superintending Engineer, PW (R&B) Circle North Srinagar, was appointed as Inquiry Officer in the matter who submitted his report, however, the same was not accepted by the Competent Authority being inconclusive and it was decided to appoint a fresh Inquiry Officer in the case; AND WHEREAS, vide Government Order No. 269-PW(R&B) of 2024 dated 12.09.2024, Er. Atul Bali, Chief Engineer, DIQC, J&K was appointed as fresh Inquiry Officer in the matter who submitted his report vide his communication No. CE/DIQC/J/2259-60 Dated 15.10.2024 with further clarification(s) vide letter No. CE/DIQC/J/741-42 Dated 24.06.2025 and No. CE/DIQC/J/1293-94 Dated 02.09.2025;
AND WHEREAS, the matter was examined on the basis of relevant factors, inquiry reports and records provided by the Anti-Corruption Bureau, J&K and it was established tnat the delinquent officer is guilty of gross misconduct having failed to maintain absolute integrity and merits consideration for penalty in terms of Rule-30 of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956; AND WHEREAS, the matter was placed before the Competent Authority/Disciplinary Authority and on consideration the Competent Authority approved to impose penalty of 'Premature retirement on proportionate pension other than that specified in Article 226(2) of J&K Civil Service Regulations' as per Rule 30(vi) of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956 on the delinquent officer; AND WHEREAS, as per Rule 33, 34 and 35 of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, Er. Ghulam Hassan Rather, the then Assistant Executive Engineer, R&B Special Sub- Division, Uri was provided an opportunity of being heard, by serving upon him a Notice under endorsement No. PWD-HRM1/97/2022-05 dated 08-01-2026 through Chief Engineer, PW(R&B) Department Central, Kashmir, to show-cause as to why the penalty as envisaged under Rule 30(vi) of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, should not be imposed on him;
AND WHEREAS, the Chief Engineer, PW(R&B) Department Central, Kashmir vide communication No.CE/R&B/CK/ADM/F-394/3472 dated 25-02-2026, enclosed the reply of the delinquent engineer and the delinquent officer also submitted the reply directly to the Administrative Department; concluded AND WHEREAS, after examination of the reply to show-cause notice, it was that the accused has not provided any fresh facts or material record that would impact or require reviewing of the decision of imposition of penalty upon him; Disciplinary AND Authority WHEREAS, the matter was again placed before the Competent Authority/ has in the Public Works (R&B) Department, who after consideration other approved than imposition of penalty of 'Premature retirement on proportionate pension 30(vi) that specified in Article 226(2) of J&K Civil Service Regulations' as per Rule of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) 요 Rules, 1956 on the delinquent officer namely Er. Ghulam Hassan Rather, the then Assistant Executive Engineer, R&B Special Sub-Division, Uri;
NOW, THEREFORE, with the prior approval of Competent Authority/ Disciplinary Authority in PW(R&B) Department sanction is hereby accorded to the imposition of penalty of "Premature retirement on proportionate pension other than that specified in Article 226(2) of J&K Civil Service Regulations" in terms of Rule 30(vi) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956, upon Er. Ghulam Hassan Rather, the then Assistant Executive Engineer, R&B Special Sub-Division, Uri, presently attached in the office of Chief Engineer, Public Works (R&B) Zone Central Kashmir with immediate effect and the simultaneous disciplinary proceedings initiated against him stand finalized accordingly."
