Srinagar, June 16: The bench of Ritu Tagore (Member Judicial) ruled that an action taken by the employer against its employee on the basis of FSL opinion cannot be held in the eyes of law & quashed the order issued by the Deputy Inspector General of Central Kashmir Range, Srinagar whereby the constable-Abdul Gaffar was treated as having deemed superannuated with effect from 29.02.2008 instead of 29.2.2010 on the basis of an alleged correction in his date of birth on the basis of FSL opinion and without giving him an opportunity of being heard before passing such an order & recorded that Forensic Science Laboratory opinion cannot dispense with the requirement of fair procedure and quashed the order of changing the retirement date of a cop working in J&K police department.
Jammu and Kashmir tourism The department alleges that Dar had manipulated his date of birth in the service records from 13.2.1950 to 13.2.1952 and after his retirement the authorities have issued the order whereby his date of retirement has been deemed to be in the year 2008 instead of 2010 with the direction for recovery of perks from him for the disputed period.
