Jammu, Sep 05: J&K Govt ordered for denial of study leave to pursue M. Tech in Soil and Water Conservation / Irrigation and Drainage Engineering on regular basis , Order copy with CTN reads as under:
Whereas, Chief Engineer, Jal Shakti (PHE) Department Kashmir vide letter No. JSD/PHE/Estt/7083-86 dated 15.07.2025 has submitted the case for grant of study leave for a period of two years in favour of Shri Amir Farooq Kutay, Assistant Engineer for pursuing Post Graduate Degree i.e. M. Tech in Soil and Water Conservation/Irrigation and Drainage Engineering through SKUAT Kashmir through regular mode, along with information on 33 point format devised by this department vide letter No. JSD/PHE/Estt/7083-86 dated 15.07.2025;
and Whereas, as per Rules 62(a) and (b) of the J&K Civil Services (Leave) Rules, 1979, the maximum duration of study leave that may be granted to a Government servant shall ordinarily be twelve months at any one time and, during the entire service, twenty-four months in all, inclusive of similar kinds of leave for study or training granted under any other rules while Rule 67(2)(a) of the said Rules, as amended vide SRO-274 dated 30.05.2013, provide that during study leave availed in India, a Government servant shall draw leave salary equal to the pay (without allowance other than Dearness Allowance) that the Government servant drew while on duty immediately before proceeding on such leave;
and Whereas, the case has been examined in the Department and it has been observed that while the Government encourages its officers to acquire additional knowledge and qualifications, the Department is presently facing an acute shortage of officers.
Moreover, the needs of the Government are adequately served by the qualification already possessed by the officer.
Therefore, at present, there is no justification for the Government to bear the cost of his higher qualification, as study leave entails such expenditure.
Now, therefore, in view of the above, the request for grant of study leave is not acceded to in view of the shortage of officers and the current assessment of the needs of the Government.
However, the officer may, if he so desires, be allowed extra-ordinary leave (without pay), without affecting his seniority.
