JAMMU,Oct 10:As DB High Court has struck down section 6 of J&K reservation Act , 2004 & rule 9,10 and 34 of J&K reservation rule 2005 and said no Promotions on the basis of reservation , Shall the J&K Government take back its own order passed from time to time in the different departments.
A bench comprising of Justice Hasnain Masoodi and Justice Janak Raj Kotwal in a land mark judgment also struck down the rule 34 which empowered the Government to consider reserved catagories also while making making temporary/stop gap/ officiating permotions.
It is pertinent to mention there are lot of such kind of cases who have not filed writ petitions in the courts It is now to see what the government will do on such type of cases and when?
They are number of officials in Jammu & Kashmir aggrieved of different Government orders, whereby Junior officials to them have been promoted over them under Reservation Act and Rules.
