J&K: Court convicts a man in Govt funds misuse case

Srinagar, June 23: A local court in Srinagar convicted one Saqib Faheem Kachroo S/o Mohammad Ashraf Kachroo R/o Bohlochipora Soura, Srinagar in case case FIR No. 48/2004 lodged under Sections 511, 420, 468, 471, 201 of the Ranbir Penal Code (RPC), at Police Station Crime Branch Kashmir.

It added that “the Directorate of School Education Kashmir invited tenders for purchase of science materials for chemistry subject from ISI/ISO certified manufacturers/ dealers and after opening of the tenders it was found that one M/s Marinex Chemie, near Gole Masjid Buhlochipora Soura Srinagar, a local SSI unit holder has produced ISO-9000 certificate bearing No. OSC-9000 purportedly issued from Rotherdam, Netherlands.

The certificate prima facie appeared to be a fake one and the tenderer has produced the same with intent to cheat the department & consequent upon the complaint a preliminary enquiry was conducted wherein the allegations leveled have been prima facie established.

Accordingly Police Station Crime Branch Kashmir lodged an FIR No. 48/2004 and started investigation & during the Course of investigation it was found that the accused person is involved in offences punishable sections 511, 420, 468, 471, 201 of RPC.

Upon the completion of the investigation, a charge-sheet was presented before the Hon’ble Court for judicial determination on 22.07.2008 and the charges under Section 511, 420, 468, 471, 201 of RPC were framed against the accused.

Hearing the case, the Hon’ble Court sentenced the accused to simple imprisonment for two years and a fine of Rs. 5000/- under Section 420 RPC, the accused shall also undergo for simple imprisonment for two years and a fine of Rs 5000, under Section 468 RPC, he shall also go for simple imprisonment for two years with fine of Rs 5000 RPC under Section 471 RPC, he shall also go for simple imprisonment for one year with fine of Rs 5000, under Section 511of RPC.

The Court further ordered that in case of default of payment of fine accused shall further suffer the simple imprisonment for six months. All the sentences shall run concurrently.
