Law Minister has to see implementations of Court orders in JK


 

JAMMU, Feb 07: Law Minister, Abdul  Haq Khan while chairing a meeting of law officers  asked lawyers to pursue pending cases efficiently to avoid unnecessary delays. He also said that Govt. has devised an effective mechanism to monitor & review the performance of lawyers & legal officers.                

He also said that Government  will fix responsibilities of the officers found responsible for leaving loopholes in the investigation that leads to adverse judgments. It is appreciable  if followed on ground not in meetings only by way of media statements for publicity.                     

CTN has lot of records of such cases in J&K for which departments are not bothering to file reply within the prescribed period fixed by the courts causing personal appearance of the higher officers despite no fault on their part.                    

As a Law Minister he should act on officer of committee which was constituted by Govt. on Khad Policy vide G.O.No. 145-Rev of 2016 dated 20.10.2016. The order further read as “Whereas in order to take holistic view in the matter, it has been felt expedient to have a true general position viz-a-viz the recorded position…….ensuring that the errors in the revenue record……..during proceeding settlement operations.”                      

Sanction was accorded to the constitution of another committee to carry out Khasra/area wise survey off all lands as recorded as gair mumkin khad, dariya, nallah etc.  comprising the following:-

  1. Chief Engineer, I&FC, Jammu (Chairman)     2)  ACR, Jammu (Member Secretary)  3) ACR, Samba (Member)     4) Tehsildar concerned        5)  Any other revenue officer

The committee shall submit report  within a period of one month from the issue of this order.                  

It can be seen when one month was over and  what has been done.  If it would have been done would have benefitted to lakh of land owners.  It is pertinent to mention here this was in ref, to order in DB in High Court in WPPIL No. 19/2014,20/2013 C/W CPPIL No. 03/2013, 07/2013, 4/2015 passed an order dated 12.02.2016 directing respondents to frame policy on khads with in a period of two months.                       

Minister should start from his department of RD&PR to verify that how many replies/actions had been withhold by officers. Filling of reply well in time would have caused early disposal of lot of cases. Otherwise only giving statement in the meeting speaks of media presence only but no outcome on ground.
