J&K: High Court seeks personal appearance of Commissioner/Secretary if fails to file compliance of judgment of 2017?

Jammu, Sept 22: In CCP(S) No. 540/2019 titled Ajit Singh V/s Ajit Kumar Sahu and othersafter hearing HON’BLE MRS. JUSTICE SINDHU SHARMA, JUDGE ORDERED as:-

22.09.2023 The respondents, in their statement of facts, have submitted that they have constituted a committee for deciding the intervening period of suspension of the petitioner vide Order No. 37-E of 2022-23 dated 04.05.2022.

This has strongly been opposed by the petitioner’s counsel, who submits that as per the judgment dated 21.12.2017, the writ petition was disposed of with a direction to the respondents to accord consideration to the claim of the petitioner with regard to retiral dues within a period of two months and it was made clear that in case the same is not considered within the said period, the petitioner would be entitled to interest @9% on the amount.

In view of the above, the respondents have not considered the claim of the petitioner for grant of monetary benefits in terms of judgment dated 21.12.2017, therefore, the respondents are directed to file their compliance report in terms of the said judgment within a period of four weeks, failing which, respondent No. 2 shall appear in person on the next date of hearing, as the petitioner is awaiting compliance of the judgment since 2017.
