High Court  directs Jammu Municipal Corporation that Officer not be made to work on an inferior post

Jammu, Sep 14: In WP(C) No. 2361/2023 tiltled Shiv Kumar vs Jammu Municipal Corporation Jammu after hearing HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE ORDERED as:-

(ORAL) 1. The petitioner is aggrieved of order dated 06.09.2023 passed by the respondent corporation whereby he has been asked to report to health section of Jammu Municipal Corporation for further duties.

2. The contention of the petitioner is that there is no post equivalent to the post of Enforcement Inspector in the health section of Jammu Municipal Corporation and by virtue of the impugned order, the petitioner will be asked to work on an inferior post, which may result in prejudice to him.

3. Issue notice to the respondents.

4. Mr. Rajnish Raina, Advocate enters appearance and waives notice on behalf of the respondents.

5. Having regard to the limited nature of grievance projected by the petitioner in the instant petition, the same can be disposed of at this stage by extending appropriate directions to the respondents.

6. Accordingly, the present writ petition is disposed of with a direction to the respondents that the petitioner shall not be made to work on an inferior post just because he has been asked to report to the health section of the Jammu Municipal Corporation.

It is further provided that the petitioner shall not be put to any disadvantage as regards his pay and perks.
