Court imposes cost of Rs 5000 to Govt for non compliance?

Jammu, Feb 13: In SWP 902/2017 IA 2/2017 IA 1/2017, titled Sushil Kumar Chatta V/s State and others, HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE  after hearing ordered as:-

"Despite last and final opportunity granted vide order dated 17.12.2019, counter affidavit has not been filed".

Mr. Sawhney vice Mr. Magotra appearing for the respondents seeks another opportunity to file counter affidavit.

On his request, further four weeks’ time is granted to file counter affidavit subject to payment of Rs.5000/- as costs to be deposited in the Advocates’ Welfare Fund.

List on 20.03.2020.

Respondents shall keep the record of the enquiry initiated against the petitioner available on the next date of hearing............

Now, question arised that who was on fault for non compliance of court orders for its early disposal..?

Shall Govt fix the responsibilty of the concerned for which Govt had fined for Rs. 5000/-...?

Shall Govt recover the same ammount from the personal pockets of the concerned defaultin officer, who failed to comply court orders to teach a lesson to such like officers to follow court orders in near future for early disposal of the cases...?
