JAMMU, Dec 02: Officers do not bother for the instructions issued by the Government from time to time for the benefit of public. Innocents never get the benefits of the schemes like Public Service Guarantee Act of 2011, RTI, Act of 2009 etc.
Public Service Guarantee Act. Of 2011 has fixed specified time frame to do the jobs of the public but had some competent authority authorized by the Govt. to verify the facts on the ground. Had the Commissioners of the concerned departments tried to enquire that whether their subordinates are making the disposal of the files well in time or with holding for vested considerations?
There are lot of cases which proves that how the officers are bothering for the Government instructions issued from time to time. Let us first take the case of GAD, the main department in the state, Shall Chief Minister/Chief Secretary look into that why the officers of GAD not bothering to file reply in the Hon’ble Courts in Compulsory Retirement cases. In some cases last & final opportunity has been granted to GAD to file reply & in some cases counter to file reply has been closed. The officers, who are not bothering for the Hon’ble Courts for early disposalof the cases are needed to be compulsorily retired as dead wood but are rewarded by the Government with prize postings clearly speaks of the work culture of the Govt.
In contempt petition 158 0f 2015 an order was passed by the Hon’ble High court, Jammu to file compliance report within two weeks but officers did not bothered for. Thereafter personal appearance of Secretary, PSC was called in next date of hearing in order dated 3.07.2015 but till date no actions by the big officers. In SWP No. 1676 of 2013 it was ordered to file affidavit in response to the supplementary affidavit filed by the appellant but the GAD big bosses till date did not bothered to file speaks their supremacy over and above the Hon’ble High Court orders.
A senior Minister of the state requisitioned an officer from Secretary, Rural Development Department, J&K vide letter dated 10.06.2015. It speaks the intelligence & efficiency that, RDD that videNo. RD/Adm/28/2015 dated 18.06.2015 a baseless communication was made by, RDD with the irrelevant comments. The said senior Minster taught a lesson to the, RDD dated 30. 06. 2015 that his communication is contradictory as required. After wasting 50 days, RDD issued the NOC for the deputation for the officer speaks how the officers are bothering for the top minister of the state. It is a matter of great concern to publicize that GAD is still sitting on the file as it has been noticed by the CTN that the request of the senior Minister of the state has neither been bothered by the Secretary, RDD nor by the Secretary, GAD.
It is a well settled preposition of law that deputation succeeds when the borrowing, lending departments and the applicant agrees & here all the three agreed but GAD officers are sitting on the file since 22.07.2015.
Shall Chief Minister take the note of and punish such like officers in near future to bring the efficiency in the administration to give justice to the innocents?, Otherwise it clearly speaks of “Delay in justice is denial of justice”.
