Jammu, Nov 5: In M.A./490/2026 (JAMMU) in O.A./1121/2023 titled JASWANT KUMAR Vs JAL SHAKTI DEPARTMENT after hearing CAT ordered as under:-
Pursuant to order dated 14.09.2026, Executive Engineer, Jal Shakti, PHE Mechanical Division, Rajouri was present personally before the Tribunal.
He submits that he has written to the Chief Engineer, and further request has been made to Financial Commissioner for release of funds, and as soon as the same is done, he will do the needful on his part.
Mr. Sahil Koul, learned counsel representing Accountant General, has put on record a letter written by the Office of Accountant General to the Chief Engineer, Jal Shakti(PHE) Department, on 20.03.2026, wherein it has been suggested that since the recovered amount has been credited to the salary head of the department, as such the amount may be refunded back to the applicant by preferring a refund bill by debit to the salary head of the Department.
Mr. Koul and Mr. Rajesh Thappa, learned Addl. A.G. have categorically made the statement that amount has to be released by the Chief Engineer, as per the letter of Accountant General, referred above, so reference made to the Financial Commissioner is not valid.
In view of the above, the Chief Engineer is directed to release the amount in favour of the applicant, failing which his salary would be stopped on the next date of hearing. List on 14.12.2026.
