Jammu, Oct 10: In C.P./16/2025 (JAMMU) [ SENIOR CITIZEN ] In O.A./1060/2021 titled KISHORE KUMAR GUPTA Vs SHALEEN KABRA AND ORS after hearng DB of CAT ordered as under:-
Learned counsel for the applicant has placed on record a copy of the order dated 25.09.2026 passed by the Hon'ble High Court in Review Petition No. 20 of 2026 titled U.T. of J&K Vs. Kishore Kumar Gupta and submitted that Review Petition has been dismissed.
Ms. Monika Kohli, learned Sr. A.A.G. appearing for respondent no. 1 has placed on record a copy of communication of even date i.e., 06.10.2026 and submitted that proposal regarding regular promotion of petitioner as Chief Engineer w.e.f. 01.03.2013 to 30.04.2018 against the vacancy which was kept reserved for him by the Establishmentcum-Selection Committee has been forwarded to the General Administration Department on 26.09.2026, for its further placement before the ECSC for consideration.
It is submitted by learned Sr. A.A.G. that she will file the compliance report as and when the aforesaid proposal will be considered by the ECSC and prayed that order dated 13.08.2026 of this Tribunal with regard to the attachment of salary of respondent no. 1 be re-called in the interest of justice and in the light of compliance report earlier filed in this petition.
Having considered the compliance report as well as the fact that case of the petitioner has already been forwarded to the GAD on 26.09.2026 for placement before the ECSC for consideration, no useful purpose will be served to continue with the order of this Tribunal for attachment of salary of respondent no. 1.
Accordingly, order dated 13.08.2026 by virute of which salary of respondent no. 1 was attached, stands re-called.
Let the compliance report be filed by learned Sr. A.A.G. on behalf of respondent no. 1 with regard to the compliance of the order of this Tribunal dated 21.10.2024 in the light of communication dated 06.10.2026 placed on record today.
List this case on 04.11.2026.
A copy of this order be furnished to Ms. Monika Kohli, learned Sr. A.A.G. and Mr. Rajesh Thappa, AAG for information.
