Jammu, July 20: In OWP No. 1334/2009 c/w WP(C) No. 1704/2019 a/w 207 others connected matters, Building Operation Controlling Authority V/s Vinod Kumar & Anr.after hearing HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDERED as under:-
WP(C) No. 1704/2019:- 1. Learned counsel for the parties fairly conceded that the issues involved in this petition are entirely different, thus, have sought its separate listing. 2. Given the aforesaid submissions,
WP(C) No. 1704/2019 is segregated from the aforesaid batch of petitions and shall be listed separately on 03.09.2026. OWP No. 1334/2009 a/w 207 others connected matters:-
1. After hearing a battery of learned counsel appearing for respective parties, this Court was apprised that the issues involved in the aforesaid batch of petitions are of public importance, involving substantial questions of law relating to implementation of Building Operation and Control Laws, being enforced and implemented by Municipal and local bodies in matters of erection, re-erection, demolition and sealing of building premises.
2. Having regard to the nature of the issues involved, this Court deems fit to have assistance of learned Senior Counsels, namely, Mr. M K Bhardwaj, Mr. K S Johal, Mr. K Nirmal Kotwal, Mr. R K Jain, Mr. Vikram Sharma, Mr. Amit Gupta, Mrs. Monika Kohli, and M/s Anil Sethi, Ravinder Bhat, Advocates, who are requested to assist this Court in formulating various questions of law that have arisen in the aforesaid batch of petitions.
This would enable the Court to take the holistic view of the issues involved therein.
3. Learned counsels named above are requested to apprise this Court of the various issues of public importance, as aforesaid by placing the same before this Court for consideration and consequent hearing, within a week’s time.
4. In addition thereto, learned counsels representing Municipal Corporation, Jammu/Jammu Development Authority/Local Bodies, shall also identify the issues and submit details by segregating the cases involving minor and major violations in the operation of Building and Control Laws, with detailed submissions to follow.
