JAMMU, JUNE 26 The Jammu Development Authority under Administrative Control of Rupesh Kumar, Vice Chairman which is in news from wee hour demolitions & for swift demolition drives, has woke up from after two decades and has served cancellation and eviction notices to 20 shops, kiosks, commercial halls, small store rooms and premises owners at JDA market in prime location of Bahu Plaza, Jammu.
In the first place, such shops, commercial halls and premises were allotted on lease of 40 years but without any codal formalities of inviting tendering bids in violation of the government order No 192 HUD/GR of 1991 dated 22/9/1991 issued by the Housing and Urban Development Department.
In the cancellation/eviction notices served and pasted outside commercial outlets on 19/6/2026 vide Order No. 93- JDA of 2026, the JDA pointed out that the allottees/occupants of 20 such shops/ kiosks and fulfilled any codal formalities and it was evident from the records that the allottees/occupants were fully aware and well versed with the fact that last date prescribed under then advertisement for submission of application for shops and commercial premises at Bahu Plaza was 31/5/2005 and that any allotment of left over shops/halls/kiosks after said date could only be made through the auction .
The JDA stated in the notices that the allottees cannot claim ignorance of the conditions governing such allotment or the statutory requirement of disposal through open auction after the cutoff date.
“Thereafter, considering entire record and provisions governing allotment commercial property, it has been found that the allotment of the aforesaid shops, halls, kiosks was made in violation of the procedure prescribed under government order No 192 HUD/GR of 1991 dated 22/9/1991 and administrative council decision No 115 dated 1/9/1991. And, therefore allotments are unsustainable in the law".
. Accordingly, the JDA stated that the allotment/leases made in favour of are hereby cancelled being improper and in violation of procedure laid down in the government order No 192/HUD/GR of 1991 dated 22/9/1991 and administrative council decision No 115 dated 1/9/1991.
Subsequently, JDA stated that the evicted allottees can take part in any auction process conducted by the JDA for the allotment of the said or any other commercial unit, subject to fulfillment of the prescribed terms and conditions vide order No JDA/CLA/19-20 dated 19/6/2026.
Accordingly, the JDA issued cancellation/eviction notices to vacate the shops, kiosks, premises by or before July 8 and also issued show cause notices under section 4 sub section (1) and (2) of the Jammu and Kashmir Public Premises (Eviction of Unauthorized Occupants) Act, 1988 to 20 other shop owners in Bahu Plaza.
It may be stated here that several lease holders have sub-let their premises and shops to others without obtaining any NOC from the JDA. In some case, the lease deed holders also removed internal walls to increase floor area between two adjoining shops, thereby violating the rules.
The JDA Estate Officer/Tehsildar Zone CD Jammu has marked the copy of the show cause notices and eviction notices to Director Land Management and JDA, Director Land Acquisition, JDA.
The Estates Officer/Tehsildar Zone CD Jammu issued the show cause notices on 24/6/2026.
