Then CEO of Patnitop Development Authority in question in HIgh Court over Building Permission Case?

Jammu, Jun 14:  Number of Officers/Officials of various Development Authorities, Municipal Corporations, Councils etc have harassed People due to lack of knowledge or intestinally delaying public works for the reasons best known to them.

One case of such harassment can be seen from a already accorded building permission by Block Development Officer but the work was stopped by then, CEO of Patnitop Development Authority, which is clear In WP(C) No. 3072/2024 filed by one Dinesh Kumar V/s UT of J&K and ors in which HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE after hearing  on 30.12.2024 ORDERED as under:-

01. The petitioner is aggrieved of the fact that by virtue of a registered sale deed dated 20.02.2024 with respect to the land measuring 03 marlas falling under khasra No.241, khata No. 198 and khewat No.50 at village Kothri Tehsil and District Ramban, he is not being allowed to construct thereat on account of interference by the Chief Executive Officer Patnitop Development Authority Kud despite the purported building permission from the end of Block Development Officer BDO Batote

02. The petitioner is seeking relief from this Court for restraining the Patnitop Development Authority and its officials from causing any interference in the course of construction of residential house by the petitioner at the site of said three marlas of ownership plot.

03. Notice to the respondents in the main petition as also in CM. 

04. Petitioner to submit registered postal covers within seven days whereupon the notice be issued to the respondents by the Registrar Judicial, Jammu.

05. List on 25th February 2025.

06. Pendency of this writ petition will not come in the way of petitioner in approaching the Patnitop Development Authority POA for seeking building permission if the area falls within the territorial jurisdiction of the Patnitop Development Authority and in case the petitioner approaches the Patnitop Development Authority POA for seeking permission then the requisite be dealt with in accordance with the rules and regulations in vogue.

Thereafter, the case was listed on 23.05.2025 & after hearing HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDERED as under:-

Ms. Chetna Manhas, learned counsel appearing for the respondents seeks and is granted as last and final opportunity of four weeks’ time for filing reply/objections.

Mr. Rajnesh Raina, learned counsel representing Chief Executive Officer, Patnitop Development Authority, Udhampur, is also directed to file reply on behalf of respondent No. 2 by the next date of hearing.

List on 19.08.2025 & thereafter the case has not been listed in High Court & only PDA can tell the status, whether permission has been granted or area do not fall under the jurisdiction of PDA & or same law & act is being used in the areas added in the jurisdiction of PDA vide SRO of 2010 or "Pick & choose" being allowed by using own super powers & are Hotels/Guest Houses under investigation of CBI for illegal constructions granted permissions for repiars/additions/alterations?
