Jammu, May 28: In C.P./96/2025 (JAMMU) In T.A./5629/2021 With M.A./851/2025 titled MOHD AKBAR BATT Vs SHALEEN KABRA AND OTHERS after hearing CAT ordered as under:-
The compliance affidavit dated 16.05.2026, as per direction of this Tribunal dated 28.04.2026 has been filed by one Ghan Sham Singh, Special Secretary to Government, Jal Shakti Department, who is not even a party in contempt petition.
The filing of said compliance affidavit reflects a casual and contemptuous attitude of respondent/Contemnor No. 2-Shaleen Kabra (IAS), Financial Commissioner (ACS), Jal Shakti Department, towards judicial process, who as per order dated 24.04.2026 was directed to file his affidavit showing full compliance of the order of this Tribunal dated 07.11.2024 and in default, to appear in person on 19.05.2026 for facing charge(s) of contempt for non compliance of the order of this Tribunal, which was upheld by the Hon'ble High Court on 18.02.2026.
It is submitted by learned A.A.G. that complete service particulars and relevant documents pertaining to the petitioners have been obtained and sometime be granted for creation of supernumerary posts in favour of the petitioners for their regularization.
In the interest of justice, further three weeks time is granted to alleged contemnor to file personal affidavit showing full compliance of the order of this Tribunal dated 07.11.2024, failing which he should remain present in Court on the next date, to face the charge of contempt.
