"In OWP No. 122/2001 c/w WP(C) No. 2183/2023 CM no. 5062/2023 titled Administrator, Jammu Municipality Vs Chairman, Special Tribunal & Ors. after hearing HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDERED as under:-
1. Heard at length this case and more it has been heard, it has added mystery to the very genesis of the case which this Court for the time being is reserving from being observed but, nevertheless, this Court calls upon Mrs. Monika Kohli, learned Sr. AAG for J&K Housing Board to come up with the record file related to the J&K Housing Board’s NOC/Consent in terms of letter No. HB/DAP/827-28 dated 09.09.1999 relatable to Building Permission Case No. 236 dated 25.09.1999 with respect to Plot No. 13, Sector-B, Block-C, Gandhi Nagar, Jammu which plot originally stood allotted in favour of one Sh. N. K. Haq in terms of Government Order No. 33-13-206-HD-A dated 16.02.1961 issued by the Housing Department, Government of Jammu & Kashmir and later on came to be purchased by Sneh Mahajan and Janak Raj Gupta, both deceased now.
2. Let the aforesaid file related to the allotment and building permission of aforesaid plot, if any, available at the end of the Jammu & Kashmir Housing Board be made available on the next date of hearing.
3. A copy of this order be provided to Ms. Nazia Fazal, Assisting Counsel to Mrs. Monika Kohli, learned Sr. AAG.
4. In the meantime, let the physical file of LPAOW No. 245/2001 be tagged with the present file and also digitally scanned.
5. List these petitions on 02.06.2026"
