Jammu, May 08: J&K Govt ordered for dropping of the charges against an Engineer on absconding from duties. Reference: No. CE/R&B/SK/ADM/9744-45 dated 13.01.2026 from the Chief Engineer, South Kashmir. Government Order No. 159-pPW(R&B) of 2026 Dated: 0.05.2026, details with CTN read as under:-
Whereas, among others, Mr. Amit Bhat, Junior Engineer (Civil), appointed under the Prime Minister's Special Package, was deputed to the Department of Disaster Management, Relief, Rehabilitation and Reconstruction vide Government Order No. 451-PW(R&B) of 2019 dated 18.10.2019, which was subsequently extended up to 31.10.2023 vide Government Order No. 149- PW(R&B) of 2023 dated 12.04.2023; and
Whereas, upon completion of the deputation period, the official was required to report back to the Chief Engineer, PW(R&B), Kashmir; and
Whereas, a report regarding the current status of Mr. Amit Bhat, S/o Shri Shuban Ji Bhat, Junior Engineer, and the reasons for his not joining the PW(R&B) Department, Central Kashmir, despite expiry of his deputation on 31.10.2023, was sought from the Department of Disaster Management, Relief, Rehabilitation and Reconstruction; and
Whereas, the Assistant Commissioner, Relief, vide letter dated 28.09.2024, reported to the Principal Secretary to the Government, Disaster Management, Relief, Rehabilitation and Reconstruction Department that Shri Amit Bhat had been relieved from his office vide Order No. 23- RRCM of 2024 dated 30.05.2024, issued under endorsement No. RRCM/Estt/E-7485305/24-25/166- 170 dated 30.05.2024; and
Whereas, vide this Department's letter dated 25.02.2025, the Chief Engineer, Public Works (R&B), Central Kashmir, was requested to furnish a report as to whether the said official had joined his office or not; and in response, the Chief Engineer, Public Works (R&B) Central Kashmir, vide letter dated 04.03.2025 intimated that the official had not joined in his Directorate as on that date; and
Whereas, a notice dated 15.05.2025 was issued to Mr. Amit Bhat, Junior Engineer, calling upon him to explain why disciplinary action under Article 128, Volume I of the J&K CSR, 1956, read with Government Instruction (1) under Sub-rule (5) of Rule 31 of the J&K Classification, Control and Appeal Rules, 1956, should not be initiated against him, failing which the matter would be decided ex-parte; and
Whereas, the official submitted his reply stating that, after being relieved on 30.05.2024, he reported to the office of the Chief Engineer, Public Works (R&B), South Kashmir on 03.06.2024; and that the Chief Engineer, South Kashmir, subsequently posted/adjusted him to the office of the Executive Engineer, R&B Division, Qazigund, vide Order No. CE/R&B/SK/ADM/2075-78 dated 03.06.2024; and that he joined the said office on 04.06.2024 and was further adjusted on the same day to the office of the Assistant Executive Engineer, R&B Sub-Division, Qazigund, where he has been continuously discharging his duties since then; and Scanned with OKEN Scanner
Whereas, after examination of the matter, the Chief Engineer, South Kashmir, was requested to conduct a formal inquiry and furnish a detailed report along with specific recommendations to this Department; and
Whereas, during the course of the inquiry conducted by the Superintending Engineer, Public Works (RBB) Circle, Kulgam, it emerged that, due to the reorganization of the Public Works (R&B) Department into Engineering Zones, Mr. Amit Bhat had joined in the office of the Chief Engineer, Public Works (R&B), Zone South Kashmir, on 03.06.2024, as he was borne on the establishment of Public Works (R&B) Division, Qazigund, prior to his deputation to the Relief Organization, which falls within the jurisdiction of Zone South Kashmir; and
Whereas, the Inquiry Officer further concluded that the issue occurred due toa communication gap arising from departmental reorganization and not due to any deliberate violation of Government orders, and accordingly recommended that the case be closed by taking a lenient view; and
Whereas, the observations of the Inquiry Officer have been found to be valid, and it is evident that the issue arose due to the reorganization of the Public Works (R&B) Department, Kashmir, into three Engineering Zones, with no fault attributable to the official; and
Whereas, the inquiry report submitted by the Superintending Engineer, Public Works (R&B) Circle, Kulgam, has been accepted by the competent authority;
Now, therefore, the charges framed against Mr. Amit Bhat, Junior Engineer (Civil), are hereby dropped.
Consequently, the disciplinary proceedings initiated in the case are hereby closed.
