Srinagar, May 06: J&K Govt issued Termination Order for un-authorized absence of Mr. Jahangeer Ahmad Itoo, Orderly, HSS Kaprin, District Shopian, details with CTN read as under:-
Whereas, Mr. Jahangeer Ahmad Itoo was appointed as Orderly in the Department vide Order No. 1313 DSEK of 1998 dated: 15.01.1998 and was subsequently posted in BHS Wasoora on the available vacant post of Orderly; and
Whereas, the official performed his duties in BHS Wasoora w.e.f 16.01.1998 to 07.2004 and thereafter remained absent from his legitimate duties un-authorizedly from August 2004; and
Whereas, he was served several show cause notices by the Drawing and Disbursing Officer, concerned on 07.03.2005 and 03.01.2009, respectively, which appeared in local dailies, asking him to resume his duties, however, he failed to do so; and
Whereas, he was again served a Show Cause Notice on 04.09.2023 at his last known residential address providing him one more opportunity to be heard; and
Whereas, he again failed to respond to the notice and continued to remain absent from his legitimate duties; and
Whereas, the matter was placed before the designated unauthorized absence committee in its meeting held on 25.10.2024 and the Committee recommended to "issue pre-termination notice to the subject" and accordingly, a Pre-termination Notice was served to him vide this Office communication No. DSEK/Estt/ B/TS/ 1486/E-7316945/1925-29 dated: 01.07.2025, providing him one more opportunity of being heard and for submission of statement of defense, if any, within 05 days; and
Whereas, no response as to the Pre-termination Notice was received from the absentee and the issue was again placed before the designated committee in its meeting held on 20.08.2025, wherein the committee has recommended to process the case for termination; and
Whereas, remaining continuous un-authorized absent from duties for more than five years attracts action as warranted in terms of Article 113 of J&K Civil Services Rules (Volume I) of 1956, which reads as under:-
"After five years of continuous absence on leave an officer is considered to be out of state employeе."
Now, therefore, in view of the above and pursuant to recommendations of the Designated Committee, Mr. Jahangeer Ahmad Itoo, Orderly, HSS Kaprin, District Shopian is hereby removed from Government Service from the date he remained un-authorizedly absent from his legitimate duties in terms of Article 113 of J&K Civil Services Rules (Volume I) of 1956 and Rule 30 (VII) of J&K CCA Rules, 1956.
