In CCP(D) 55/2022 in SWP No. 415/2019, ССР(D) No. 56/2022, ССP(D) No. 57/2022, CCP(D) No. 59/2022, CCP(D) No. 29/2023 titled Shabir Ahmad Mir and others Vs Shri Arun Kumar Mehta and others - CCP(D) No. 28/2023 in SWP No. 1477/2018 titled Yasmeena Rehman and Anr. Vs. Shri Alok Kumar and others: Central Administrative Tribunal order dated 27.09.2023 and 02.12.2024, DSEK orders for appointments & postings as Teachers, details with CTN read as under:-
Whereas, the Jammu & Kashmir Service Selection Board invited applications from the eligible candidates for selection against the posts of Teacher advertised vide Notification No. 06/2017 under various Items for the post of General/ Science & Math/ Urdu Teacher (Education Department), District Cadre Srinagar/ Baramulla/ Budgam/ Bandipora/ Anantnag; and
Whereas, after issuance of select list, various candidates approached the Hon'ble Court of Law seeking direction upon the recruitment board viz. JKSSB to award appropriate points to them for possessing higher qualification, work out their merit accordingly and call them for counselling.
The petitions were disposed by the Hon'ble Court directing the respondent Service Selection Board to call the petitioners therein for counselling, verify their documents and assess their grade in terms of the documents so produced by them; and
Whereas, aggrieved of the decision of the learned Single Judge, the Service Selection Board challenged the directions passed by the learned Single Judge before the Division Bench of Hon'ble Court, who disposed the petitions by passing an Order dated 27.04.2021, operative part of which reads as:.
"Accordingly, the appeals filed by the Board, being LPA Nos. (1) 35/2019; (ii) 117/2019; and (iii) 237/2019, are dismissed along with all connected CMs therewith. Consequently, the connected Writ petitions bearing SWP Nos. (i) 414/2019; (ii) 415/2019; (iii) 831/2019; (iv) 1463/2018; (ix) (v) 1477/2018; (vi) 1495/2018; (vii) 1545/2018; (viii) 1907/2018; (ix) 2453/2018; (x) 466/2019; and (xi) 1442/2018, along with writ petitions bearing SWP No.'s 1496/2018; 1965/2018 and 2125/2018 -subject matter of the three appeals, are allowed and the consideration Orders passed by the Board in regard to the claim of the writ petitioners, as impugned in any of the Writ petitions before us, shall stand quashed.
The Board is directed to assign appropriate points to all the relevant qualifications omitted by the Writ petitioners in their online application forms including the qualification of B.Ed, to the credit of the writ petitioners, of course, in case the same have been acquired by these petitioners prior to the last cut-off date of the advertisement notice concerned; evaluate their merit on the basis of such award of points, and redraw the final selection list(s) for the posts in question, accordingly.
This exercise shall be undertaken and concluded by the Board expeditiously, and in any case, not later than eight weeks from the date of this order.
Insofar as the two connected Contempt petitions are concerned, viz. CPSW Nos. 695/2018; and 624/2018, same, in view of the aforesaid directions, shall stand disposed of accordingly."
Whereas, subsequent to the dismissal of LPAs, the J&K Service Selection Board approached the Honble Supreme Court of India against the decision of the Division Bench of Hon'ble High Court and the Hon'ble Apex Court dismissed the same with the following order:-
"The special leave petition shall stand dismissed. However, we leave open the question of law which have been raised by the learned counsel for the petitioner."
Whereas, pursuant to the directions passed by the Hon'ble Court, the J&K Service Selection Board constituted a committee vide Order No. 379-SSB of 2024 Dated 06.11.2024 regarding re-validation/ operation of wait list related to the selection of teachers for various districts of Kashmir division under Advertisement No. 06 of 2017 Dated 28.12.2017; and
Whereas, the J&K Service Selection Board placed the matter before the Hon'ble Council of Ministers in order to review and reconsider the decision taken by the Administrative Council (AC) regarding withdrawal of posts to the extent of instant selection and obtain these posts from the School Education Department (SED) against whom recommendation would be made, however, the General Administration Department vide communication dated 25.02.2025 made the following observations:-
"The proposal mixes up the redrawing of the merit list which is for the SSB to do and allowing an exception to the Administrative Council decision dated 29.01.2022 which the CoM has to do. Please make the requisite correction, specify the number of posts for which exception is being sought by reference to the relevant indents, and resubmit."
Whereas, a fresh committee vide Order No. 90- SSB of 2025 Dated 20.03.2025 was constituted in the matter, wherein, it was decided that the School Education Department shall assist the committee constituted by the J&K Service Selection Board vide Order No. 379-SSB of 2024 Dated 06.11.2024 (revalidation committee) in the contempt petition titled "Shabir Ahmad Mir VS Arun Kumar Mehta".
The mandate of the revalidation committee constituted by the JK SSB was extended to examine the redrawing of merit list in light of communication received from the General Administration Department, enabling the JK SSB to resubmit the proposal before the Hon'ble Council of Ministers through General Administration Department concerning the post of Teachers; and
Whereas, the Service Selection Board vide communication dated: 27.05.2025 forwarded a final report of designated committee/re-drawn merit list to the School Education Department, wherein it was examined and referred to the General Administration Department for allowing to operationalize the redrawn merit list in compliance to the Hon'ble High Court directions; and
Whereas, the General Administration Department vide U.O No. GADMTGORBJIV/2/2025 dated: 30.07.2025, returned the case to the School Education Department with the following advice:
"Returned: The Departmental proposal has been examined in light of the Hon'ble High Court order dated 05.05.2025, wherein the Hon'ble Court inter-alia has directed as under:-
"We make it clear that to comply with the concluded judgment of Ministers. this Court, the respondents do not require any approval by Council of Ministers.
Accordingly, the department is advised to take further action in light and Parliamentary Court directions in consultation with Departmental of Law, Justice Board."
Whereas, in the contempt petition CCP(D) /28/2023 titled Yasmeena Rehman and Anr. V/S Shri Alok Kumar and Ors, and clubbed matters, the Hon'ble High Court has passed the following Orders on 01.08.2025:-
".......Let on the matter be listed for consideration on Monday i.e. which date the Commissioner/Secretary Government School Education, to the Board, shall and the Chairman J&K, Service Selection remain present before this Court along with the appointment orders of the petitioners.
They shall have option of appearing through virtual mode." Whereas, pursuant to the advice of the General Administration Department vide U.O dated: 30.07.2025, School Education Department vide letter dated: 30.07.2025 requested J&K SSB to furnish the recommendations in favour of the petitioners and in reply the JKSSB, vide communication No.: JKSSB-LEG/12/2023-03(E-7104707) dated: 12.08.2025, furnished the same; and
Whereas, pursuant to the recommendations of the JKSSB and Hon'ble Court directions appointment order in favour of 18 petitioners against the post of teacher was issued vide Government Order No.: 559-JK (Edu) of 2025 dated: 12.08.2025 who were subsequently directed to report this Directorate for further adjustment; and
Whereas, upon the receipt of satisfactory Character and Antecedents verification from CID, 15 (fifteen) candidates were adjusted in different Districts of Kashmir Division, 14 (fourteen) vide Order No.: 296 DSEK of 2025 Dated: 27.10.2025 and 01 (one) candidate vide Order No.: 327 DSEK of 2025 Dated: 20.11.2025 respectively; and
Whereas, the recommendations in respect of below mentioned two petitioners was kept withheld by the JKSSB on account of deficiency as indicated against each:-
Mehraj ud din Sheikh S/O Gh Ahmad Sheikh R/O Vizer Wagoora Baramulla & Aamina Hassan D/O Gh Hassan Malik R/O Aadipora Malikpora Sopore, Baramulla,
Whereas, subsequently, the above mentioned candidates by means of representations submitted the requisite documents for the release of their withheld recommendations before the JKSSB and were accordingly placed before the Board Members of the Service Selection Board in 326th Board meeting held on 28.11.2025
"The Board perused the documents submitted by the candidates and decided to release their recommendation." two Whereas, acting on the recommendations of the Board meeting, the Service Selection Board vide letter No.: JKSSB-LEG/12/2023-03(E-7104707) Dated: 31.12.2025 (conveyed to School Education Department) released the withheld recommendations of the above mentioned 02 (two) petitioners with a rider that the other terms and conditions as conveyed vide letter No.: JKSSBLEG/12/2023-03 (E-7104707) Dated: 12.05.2025 shall remain the same; and
Whereas, the School Education Department vide letter No.: EduLGLOKmr/222/2023-08(7231167) Dated: 27.01.2026 forwarded the letter Page 3 of 5 dated: 31.12.2025 from JKSSB to this Directorate for appropriate action under rules; and
Whereas, this Directorate vide Notification No. 01-DSEK of 2026 Dated: 04.03.2026 informed the above mentioned 02 (two) petitioners to submit all the testimonials/certificates (in original) and Verification of Character and Antecedents Form prescribed by the Government in light of Order No.: 528- JK(GAD) of 2021 dated: 21.06.2021 before this Directorate; and
Whereas, both the candidates submitted the requisite documents/ certificates before this Directorate; and Whereas, satisfactory Character and Antecedents report has been received in favour of Mr. Mehraj Ud din Sheikh S/O Gh Ahmad Sheikh R/O Vizer Baramulla vide Form No. 14897 Dated: 01.04.2026 from the CID;
Now, therefore, upon due consideration of the applicant's case, in compliance with the order/judgement dated: 27.04.2021 passed in CCP (D) No. 28/2023 in SWP No. 1477/2018 titled Yasmeena Rehman and Anr. Vs Shri Alok Kumar and others, clubbed with CCP (D) 55/2022 in SWP No. 415/2018, ССP (D) No. 56/2022, CCP(D) No. 57/2022, CCP(D) No. 59/2022, CCP(D) No. 29/2023 titled Shabir Ahmad Mir and others Vs Shri Arun Kumar Mehta & others and as recommended by the J&K Service Selection Board vide communication No.: JKSSB-LEG/12/2023-03(E-7104707) Dated:31.12.2025 and in view of the receipt of satisfactory Character and Antecedents report from CID, Sanction is hereby accorded to the appointment and adjustment of the below mentioned petitioner as Teacher in the Pay Level-5 (29200-92300) in the stream/cadre as shown below
MEHRAJ GH UD DIN AHMAD. The conditions of probation, pay and allowances and fixation of initial tenure shall be governed by Jammu & Kashmir Probationer (Condition of service, pay and allowances) and fixation of tenure rules issued vide SO 192 of 2020 Dated 17.06.2020 read with Govt. Order No. 654- JK(GAD) of 2020 Dated 19.06.2020.
The appointee shall report in the Office of Chief Education Officer, Baramulla within a period of 21 days from the date of issuance of this order and shall be allowed to join only on production of the following documents/certificates (in original) to be verified subsequently:
i. Academic Qualification Certificate. ii. Date of Birth Certificate. iii. Health Certificate from the Chief Medical Officer of the District. iv. Domicile Certificate. v. No Loan Certificate under Self Employment Scheme from DIC concerned and Employment Department. vi. Undertaking regarding no criminal records.
The appointment of the appointee shall further be subject to the following conditions: I. If, on verification of the qualification certificates/DOB and other documents form the concerned issuing authority are proved fake/forged, the claim of the appointee for appointment as (Teacher) shall be deemed to have been cancelled ab-initio and the legal action as warranted under rules shall be initiated against him.
The salary of the appointee shall not be drawn and disbursed to him unless satisfactory report in respect of qualification/other
certificates are received from the concerned issuing authority. If, the candidate fails to join within a period of twenty one (21) days from the date of issuance of order, he shall forego right to appointment, which shall be deemed to have been cancelled abinitio without any further notice.
