J&K Govt issues "Pre Termination Notice" to Teacher for unauthorized absence since years

Srinagar, May 06: Director issued  a Pre-Termination Notice to Ms. Raihana Akhter, Teacher, MS Katoo, Zone Srigufwara-Anantnag, details with CTN read as under:-

Whereas, after availing one month child care leave w.e.f 16.08.2017 to 15.09.2017, sanctioned by Zonal Education officer Srigufwara vide Order No. ZEO/S/2925-27/17 Dated 16.08.2017, you failed to resume your legitimate duties instead preferred to proceed outside the country without obtaining prior permission/leave sanctioned from the competent authority; and

Whereas, vide communication No. ZEO/S/3122-23 dated: 26.09.2017, a Show cause notice was served upon you by the ZEO concerned directing you to resume your duties forthwith, failing which disciplinary proceedings shall be initiated against you; and

Whereas, instead of joining the duties, you represented before the ZEO concerned on 03.10.2017 with the request for extension of child care leave or any other leave due in your favour for a period of one year commencing from October 2017 together with station permission leave; and

Whereas, after receiving instructions from Chief Education Officer Anantnag dated 26.05.2018, the ZEO concerned sanctioned Extra Ordinary Leave in your favour vide No. ZEO/S/419/18 Dated 31.05.2018 w.e.f 01.10.2017 to 31.05.2018 and from 01.06.2018 to 30.11.2018; and

Whereas, you again failed to resume duties after expiry of Extra Ordinary Leave sanctioned in your favour; and

Whereas, Zonal Education Officer Srigufwara vide communication No. ZEO/S/Estt/4925-29/21 dated: 29.12.2021, served upon you another notice published in "Kashmir Vision" dated 31.12.2021, thereby providing you an opportunity for resuming your legitimate duties/ submitting of statement of defense failing which your case for the termination of services without issuance of further notice shall be initiated; and

Whereas, instead of resuming duties/submitting statement of defense, you again represented before the DDO concerned for extension in Extra Ordinary Leave for two more years without justifiable grounds; and

Whereas, un-authorized absence from legitimate duties of a Government Employee attracts action as warranted in terms of Article 128 of J&K Civil Services Regulations (Vol-I), 1956, which inter alia provides:-

              "Absence without leave or after the end of leave involves loss of appointment” and;

Whereas, the matter was placed before the Designated un-authorized absence Committee in its meeting held on 20.08.2025, the committee recommended, "to issue pre-termination notice".

Now, therefore, through the medium of this notice, you are hereby given a final opportunity to explain as to why action as warranted in terms of Article 128 of J&K Civil Services Rules (Volume 1) of 1956, shall not be initiated against you for remaining wilful, un-authorizedly absent from your legitimate duties since 01.06.2018.

Your reply shall reach this office within a period of 10 days from the date of issuance of this notice failing which it will be presumed that you have nothing to say in your defense and action as warranted under Service Conduct Rules shall be initiated against you, accordingly.
