Srinagar, May 05: Director, school Education issued notice for Termination Order for unauthorized absence, details with CTN read as under:-
Whereas, Mr. Mohammad Hayat, was appointed as Teacher in District Cadre Budgam vide Order No. 509- DSEK of 2009 dated: 15.06.2009 and subsequently posted in High School Falchil;
and Whereas, the official remained absent from his legitimate duties un-authorizedly from 03.04.2015 and was served a show cause notice by the Drawing and Disbursing Officer on 17/04/2015, asking him to resume his duties, which he failed to do so; and Government of Jammu & Kashmir Directorate of School Education Kashmir.
Whereas, he was again served a Show Cause Notice by this Directorate on 15.09.2022, which he replied but the same was found un-substantial and un-satisfactory;
and Whereas, a Final Notice was served to him vide this Office communication No. DSEK/Estt/III/B-Trs/TS-593/NZ/113/022/5862 dated: 09.01.2023, affording him an opportunity of being heard within 07 days before action under Article 128 & Article 113 of J&K CSR CSR (Vol-I) of 1956 is initiated against him;
and Whereas, the CEO Budgam vide letter No. CEOB/Estt/2024/37460 dated:- 12/11/2024 submitted that Mr. Mohammad Hayat has not yet joined the school despite the Final Notice dated:- 09.01.2023 issued by the Directorate which was served to him on his last known address;

Whereas, remaining un-authorizedly absent from duties for more than five years attracts action as warranted in terms of Article 113 and Article 128 of J&K Civil Services Regulations, CSR (Volume I) of 1956, which reads as under:-
Article 113: "After five years of continuous absence on leave, an officer is considered to be out of state employee."
Article 128: "Absence without leave or after the end of leave involves loss of appointment."
3. Now, therefore, in view of the facts enumerated above Mr. Mohammad Hayat, Teacher, HS Falchil, District Budgam is hereby removed from Government Service in terms of Article 113 of J&K Civil Services Regulations, CSR (Volume I) of 1956 and Rule 30 (VII) of J&K CCA Rules 1956.
