Jammu, Dec 09: In CPSW No. 104/2018 in SWP No. 2509/2016 titled Jyoti Devi Vs Hardesh Kumar & Ors. after hearing HON’BLE MR. JUSTICE JAVED IQBAL WANI, JUDGE ORDERED as under:-
1. Perusal of the record of proceedings reveals that on three previous consecutive dates, the counsel for the respondents/contemnors came to be directed to submit the status of the Special Leave Petition (SLP), claimed to have been filed by the respondents against the judgment and order, noncompliance of which is complained of in the instant contempt petition.
Today as well, no information in writing or else regarding the proof of listing of the Special Leave Petition is produced before this Court by the counsel for the respondents/contemnors.
2. Under these circumstances, this Court is compelled to take recourse of coercive measures against the respondents/contemnors for ensuring the compliance of the judgment and order dated 07.11.2017 and, as such, direct Registry to secure the presence of respondent 2 in the first instance by issuance of bailable warrants to the tune of Rs. 10,000/- to be executed by the SSP concerned.
