Jammu, Dec 03: In C.P./110/2022 (JAMMU) In O.A./62/2022, C.P./139/2023 Along With C.P./99/2024 CONTEMPT C.P./123/2024 CONTEMPT C.P./139/2023 RECOVERY C.P./97/2024 CONTEMPT titled VARINDER KUMAR Vs SUNIL KUMAR SHARMA, EXECUTIVE ENGINEER, JAL SHAKTI. after hearing CAT ordered as under:-
l Vide order dated 17.03.2023 (in connected OAs) read with order dated 02.12.2023 (in MA No. 900/2023), the respondents were directed to refund the recovered amount of the petitioners within six weeks without interest.
Thereafter, the respondent - Department approached the Hon'ble High Court, where the appeal was dismissed on 10.04.2025. Subsequently, the Department filed a Special Leave Petition before the Hon'ble Supreme Court, which was also dismissed vide order dated 18.07.2025.
Now, approximately five months have passed since the final order, yet the contemnors have failed to comply on various pretexts and have expressed their intention to file a Review Petition before the Hon'ble Apex Court.
Despite 47 adjournments and multiple opportunities granted to the contemnors to comply with this Court's order, no compliance has been done till date.
Mr. Surinder Mohan Pal, XEN, PHE Division Samba, was present physically before this Court. Taking serious note of such non-compliance, this Court is constrained to issue bailable warrants with two surety bonds each to the tune of Rs. 25,000/- against the following contemnors:
i. Shaleen Kabra, Commissioner / Secretary to Govt., Jal Shakti Department; ii. Mohd. Hanief, Chief Engineer, Jal Shakti Department, Narwal, Jammu; iii. Surinder Mohan Pal, Executive Engineer, Jal Shakti Department, PHE Division Samba.
Further, the Senior Superintendent of Police (SSP), Jammu is directed to execute these bailable warrants and ensure the presence of the above-mentioned contemnors before this Court.
List on 30.12.2025. Registry is directed to supply a copy of this order to SSP Jammu for compliance.
