CAT asks SSP  Jammu to execute bailable warrant & ensure presence of Secretary, J&K SSB

Jammu, Oct 22: In C.P./380/2024 (JAMMU) [ CONTEMPT ] In O.A./66/2024 With M.A./1553/2025 titled MALOOK SINGH Vs MR CHANDRAKER SHARMA IAS, HOME DEPARTMENT F after hearing CAT ordered as under:-

              The instant Contempt Petition (in short C.P.) No. 380 of 2024 has been preferred by the applicant being aggrieved of the non-compliance of the order dated 14.08.2024 passed by this Tribunal in Original Application bearing No. 61/66/2024 titled “Malook Singh vs. UT of J&K & Ors.”

2. The C.P. was listed today, and on perusal of record, it was shockingly revealed that the contemnors have been granted several opportunities to file the compliance report in pursuance to the order passed in the main case, but they have still failed to file the compliance report.

Vide orders dated 12.03.2025, 16.04.2025, 02.06.2025, 11.07.2025, 08.08.2025 and 11.09.2025, the contemnors have been granted opportunities with sufficient time to file the compliance report, failing which the Erring Officers were directed to remain present before this Court on the next date of hearing and explain why contempt proceedings be not initiated against them.

Despite issuance of said orders, the contmenors have neither filed the compliance report nor did they bother to appear through video conferencing before this Court with explanation as to why the compliance has not been filed yet.

3. Since the contemnors have failed to appear before this Court today as well, as per the directions given on the previous dates of hearing, we are left with no other option but to issue bailable warrants with two surety bonds to the tune of Rs. 25,000/- each for ensuing presence of contemnor no. 3 i.e., Mr. Atul Kumar, JKAS, Secretary, J&K Service Selection Board, Hema Complex, Sector 3 Channi Himmat, Jammu180015 before this Court on the next date of hearing positively.

4. The Senior Superintendent of Police, Jammu is directed to execute this bailable warrant and ensure the presence of abovementioned contemnor.

5. List the matter on 24.11.2025.
