J&K: CAT questions working of Secretary, Jal Shakti & CE for no actions despite 45 opportunities , Seeks "PA"?  To frame "ROBKAR" in noncompliance

Jammu, Oct 22: In C.P./110/2022 (JAMMU) In O.A./62/2022, C.P./139/2023 Along With C.P./99/2024, C.P./123/2024, C.P./139/2023, C.P./97/2024 titled  VARINDER KUMAR Vs SUNIL KUMAR SHARMA, EXECUTIVE ENGINEER, JAL SHAKTI (PUBLIC HEALTH ENGINEERING DEPARTMENT), SAMBA after hearing CAT ordered as under:-

               Vide order dated 09.10.2025, it was intimated to the Court that the Hon'ble High Court of J&K as well as the Hon'ble Supreme Court has already dismissed the petition filed against the order in question in the C.P.

Moreover, 45 adjournments has already been granted to the contemnors to comply the order however, they failed to do so.

Today, Mr. Surinder Mohan Pal, Executive Engineer, Jal Shakti, PHE, Samba has appeared before this Tribunal in person, physically, and stated that the liability was Rs. 1.3 Crore and he has no money.

He further stated that he has raised the matter with the Govt. on 30.07.2025 and also written a letter to the Superintending Engineer on 28.08.2025.

In the interest of justice, the Secretary, Jal Shakti, and the Chief Engineer is directed to appear before this Tribunal in person on the next date of hearing and explain why the contempt proceedings would not be initiated against him despite giving 45 opportunities.

In case, they will not present on that day, Robkar will be framed against them for non-compliance.
