Jammu, Sep 27: In C.P./95/2025 (JAMMU) In T.A./3212/2020 titled SAJJAD AHMED WANI Vs SMT SHEETAL NANDA AND ORS after hearing CAT ordered as under:-
The instant Contempt Petition (in short C.P.) No. 95 of 2025 has been preferred by the applicant being aggrieved of the non-compliance of the order dated 27.11.2024 passed by this Tribunal in Transferred Application bearing No. 61/3212/2020 titled “Sh. Sajjad Ahmed Wani vs. Union Territory of J&K & Ors.”
2. The C.P. was listed today, and on perusal of record, it was shockingly revealed that the contemnors have been granted several opportunities to file the compliance report in pursuance to the order passed in the main case, but they have still failed to file the compliance report.
Vide orders dated 09.06.2025, 21.07.2025 and 21.08.2025, the contemnors have been granted opportunities with sufficient time to file the compliance report, failing which the Erring Officers were directed to remain present before this Court on the next date of hearing and explain why contempt proceedings be not initiated against them.
Despite issuance of said orders, the contmenors have neither filed the compliance report nor did they bother to appear through video conferencing before this Court with explanation as to why the compliance has not been filed yet.
3. Since the contemnors have failed to appear before this Court today as well, as per the directions given on the previous dates of hearing, we are left with no other option but to issue bailable warrants with two surety bonds to the tune of Rs. 25,000/- (Rupees Twenty-Five Thousand only) each for ensuing presence of contemnor no. 2 i.e. Sh. Suneesh Buxy, Director, Social Forestry, Jammu-180001 before this Court on the next date of hearing positively.
4. The Senior Superintendent of Police, Jammu is directed to execute this bailable warrant and ensure the presence of abovementioned contemnor.
5. List the matter on 03.11.2025.
