J&K: High Court seeks "Personal Appearance" of 02 Pr Secretaries, if fail to file compliance?

Jammu, Oct 21: In CPSW No. 648/2017 titled Anil Raina and others Vs Dheeraj Gupta, Secy. PDD and another after hearing HON’BLE MR. JUSTICE JAVED IQBAL WANI, JUDGE ORDERED as:-

In the instant petition, disobedience of the judgment dated 20.07.2016 passed by this Court in SWP No. 1911/2013 is being alleged against the respondents/contemnors.

According to the petitioners, the judgement has assumed finality after the Letters Patent Appeal as also the SLP filed by the respondents/contemnors before the Apex Court came to be dismissed yet the respondents/contemnors till date failed to comply with the aforesaid judgment, despite umpteen opportunities granted by this Court.

Learned counsel for the respondents/contemnors admits of the position holding of the judgement passed by this Court by the Letters Patent Bench as also by the Apex Court, however, learned counsel would contend that the respondents/contemnors are in the process of complying with the judgment supra and have referred the matter to the Finance Department for obtaining its concurrence.

Learned counsel, thus, would pray for four weeks time for reporting compliance of the judgement.

In the interest of justice, four weeks last and final opportunity is granted to the respondents/contemnors to comply with the judgement supra, failing which the respondents/ contemnors i.e. Commissioner/Secretary to Govt., Power Development Department, J&K and Commissioner/Secretary to Govt., Finance Department J&K shall appear in person along with the record of the case.
