Jammu, Oct 14: In WP(C) No.1525/2020 titled Rajeshwar Singh and others V/s UT of J&K and others after hearing HON’BLE MR. JUSTICE RAJESH SEKHRI, JUDGE ORDERED as:-
A perusal of the objections filed by the official respondents No.5 and 6 would reveal that in compliance to the decision of the Board of Directors of JDA, the land acquisition proceedings were initiated by Collector JDA when acquisition of 1.008 kanals of land falling under Khasra No.35 and Notification under Section 4(1) followed by Section 5 and 5 (A) of the Land Acquisition Act was issued.
However, it further reflects that the Board of Directors of JDA approved the proposal for rescinding the decision taken in the 78th BOD vide Supplementary Agenda Item No.78.07 (S).
Mr. Adarsh Sharma, learned counsel appearing for respondents No.5 and 6 seeks and is granted two weeks’ time to furnish copy of the said decision taken in the 78th BOD regarding rescinding of earlier decision of acquisition to learned counsel for the petitioners.
