High Court awards Rs 50,000 compensation from Policemen Pocket to man for illegal detention in lock-up

New Delhi, Oct 7: The Delhi High Court ordered a compensation of Rs 50,000 to a man who was kept in a police lock-up for about half an hour by two police officials without following the due process of law, saying that it is troubled at the way the citizens are being treated by the police authorities who behave as if they are above the law.

The compensation has been ordered to be recovered from the salaries of the two policemen who illegally arrested one Pankaj Kumar Sharma and kept him in detention in the police lock-up in Badarpur police station on September 2 last year.

Justice Subramonium Prasad awarded the compensation to Pankaj Kumar Sharma while hearing his plea seeking compensation for his illegal detention.

The time spent in the lock-up by the petitioner, even for a short while, cannot absolve the police officers who have deprived the petitioners of his liberty without following the due procedure established by law,” Justice Prasad said in the order & expressed his displeasure at the high-handed way in which the police officials acted, throwing to winds the constitutional and fundamental rights of a citizen.

A meaningful message must be sent to the authorities that police officers cannot be law unto themselves, the High Court added.
