Apex Court Upholds Judgment Treating Daily Wage Employee Working On Sanctioned Post As Central Govt Employee For Child's Admission In Kendriya Vidyalaya

New Delhi, Sep 11: The Supreme Court has refused to entertain a Special Leave Petition by Kendriya Vidyalaya, challenging an order of the Himachal Pradesh High Court wherein it had directed the school to grant admission to the petitioner in Class-9, if he was otherwise in the merit.

The Division Bench of the High Court had observed that “an employee working on the post sanctioned by the Government is also required to be considered as Central Government employee”.

In the case, the petitioner was a bona-fide Himachali and belonged to the scheduled tribe category. He had applied for admission to Class IX being ward of a Central Government Employee.
