DB dispensed with PA of DC for the time being: Directs CS to file Affidavit in two weeks


Srinagar, October 6: In OWP No.279/2011 titled Mohammad Amin Khan Vs. State and another  after hearing a DB of HON’BLE THE CHIEF JUSTICE HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE O R D E R E D as:-

 1. The court vide order dated 27.09.2022 had specifically required Sh. Hilal Ahmad Wani, learned AAG, to file affidavit of the Chief Secretary and to ensure presence of District Collector/Deputy Commissioner, Baramulla on the next date of hearing i.e., today.

2. In the morning when the case was taken up, the District Collector/Deputy Commissioner, Baramulla was not present. It was informed that she is pre-occupied with 14 (fourteen) important cases which have been listed before her for consideration.

3. In the post lunch session, learned Advocate General has appeared and submitted that the officer was on way and had actually reached the court but not in time.

4. The officer is before us and she realizes that the court ought to have been given top priority rather than any other official work. She submits that she has spoken to the Commissioner Secretary, Revenue and it has been informed that the Chief Secretary would be filing his affidavit within a week or so.

5. The officer tenders her unconditional apology for not attending the court in time.

6. In view of the above, we direct Mr. Hilal Ahmad Wani, learned Additional Advocate General, to file the affidavit of the Chief Secretary as directed within a period of two weeks. The personal attendance of the District Collector/Deputy Commissioner, Baramulla is dispensed with for the time being.

7. List this matter on 28.10.2022.
