
Jammu, April 04: In PIL No. 7 of 2014, in PIL No. 19 of 2012 titled Dewakar Sharma and Another v/s State of J&K and Others after hearing a bench HON’BLE CHIEF JUSTICE HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDERED as:-
1. A complete ban was imposed on the mining in River Tawi vide court’s order dated 17.11.2016 passed in the writ petition, Ashish Sharma and another v. State.
2. Application No. 1015/2022 has been moved by Sh. Parag Sharma, learned counsel for most of the stone crushers added as private respondents in the writ petition seeking modification of the above order so as to allow limited mining in the river bed of Tawi.
3. A similar application (CM No. 2180/2022) has been moved by Sh. Ravinder Gupta, AAG on behalf of Union Territory seeking modification again of the same order dated 17.11.2016 imposing ban on mining.
4. A copy of both these applications be supplied to Sh. Sunil Sethi, senior counsel appearing as amicus curiae in the matter so that he may study the matter and may also, if necessary, seek expert advise as to whether ban on mining may be continued or if it can be lifted to a limited extent.
5. List on 06.05.2022.
6. The copies of these applications may also be provided to Sh. Adarsh Sharma, learned counsel appearing for the Jammu Development Authority.
