Shall Governor look into existence of “UTEIC” in J&K ?


JAMMU, Feb 16: An order was issued by Housing & Urban Development Department vide Govt. order No. 190-HUD of 2001 dated 14.08.2001 in which a committee was constituted for issuance of NOC’s for construction of commercial buildings headed by Divisional Commissioner as its Chairman.IGP Traffic, IGP Range, VC JDA, SE (PWD), Chief Town Planner etc. of concerned province were its members/member secretary.

The terms of reference of the committee were as (2) To consider & examine cases relating to permission of construction of Traffic generating buildings such as cinemas, shopping complexes etc, proposed to be constructed near or in the immediate vicinity of main roads or on roads having high density of traffic.

Traffic density is the total number of vehicles occupying a given length of highway. Density is inversely proportionate to volume of traffic. Jam density referred to extreme traffic density associated with completely stopped traffic flow, usually a range of 185-250 vehicles per mile per lane.

 It is pertinent to mention here that an applicant submitted a plan for sanction vide submit No. 209 dated 30.05.2013. The applicant got all NOC’s except DLM, JDA & AC(R) Samba. Later ACR(R) VIDE No. 1057 dated 20.02.2015 clarified to VC JDA as “The land measuring 2kanal 04 marla is private land and the land use is governed by Master Plan of 2021” after the nishandehi of the said plot.  

It is very interesting to mention here that after a gap of  months, then VC JDA communicated to Divisional Commissioner, Jammu that the said plan is rejected as NOC of AC(R) is not clear in violation of Municipal Building Bye Laws of 2011 & PSGA of 2011.                   

Thereafter a new story took place JDA put a new condition for NOC from UTEIC on the said plan in violation of Art. 14,16 of constitution of India. Lot of big construction plans like Banquets, Hotels, Commercial Comlexes, ETT college etc. were sanctioned by JDA prior to this plan without UTEIC NOC is a proved matter of enquiry by a high level committee to detect a big scam of corruption. It is also to mention here that the applicant got its residential plan sanctioned & later she requested for sanction of Commercial plan on the same land. It is pertinent to mention here that on Birpur road mix land use is permissible as per land use that how is violated.

 It is to mention here that new condition cannot be imposed in the later stage when once the plan is put on line to allied departments. It clearly speaks of pick &choose of one’s choice. It is also reported that the applicant got all NOC’s of UTEIC members but again shocked to write here that Divisional Commissioner vide No. 402/2015-UTEIC/1791 dated 31.12.2 communicated to Deputy Commissioner, Samba after conducting the meeting on the matter 0n 31.12.2015 for verification of land use since last 20 years, for which the certificate of concerned Tehsildar was already enclosed. Thereafter on  18.01.2015, D.C. Samba communicated to Tehsildar, Bari Brahmna for the same matter. It clearly speaks of the work culture that how much time takes for simple jobs in the state.

If the land tiltle was to be verified it would have done in the first UTEIC meeting but new thing come up in every meeting just to delay the jobs of innocents. Till date no response of Div. Com. Communication by D.C.Samba speaks that if such a big boss not replied till today, what shall be fate of other innocents                   

It is pertinent to mention here that big commercial complexes are constructed 100% opposite to the land of applicant without plans and  in back side  JDA is constructing it’s Birpur Colony. Different yard stick has been utilized for the plan of the applicant for mental harassment despite mix land use permitted speaks of what so ever one can think of super power of officers on laws.

It is the need of the day to enquire the matter by a high level committee to detect the pick & choose scam of JDA/SDA/JMC/SMC that how many commercial plans they have sanctioned for commercials after issuance of UTEIC order dated 14.08.2001.
