Jammu, Dec 22: Justice Sanjay Kumar Gupta while dismissing the petition of one Shahida Mir who by fraudulent means attained the post of Mukhi Savika in the respondents department directed the authorities to proceed against a Government employee for making forged signatures of her higher ups for getting undue promotions for which she was not entitled beside manipulating the things for getting undue benefit of promotion, has also committed criminal act, so she is not entitled to any protection as provided under Article 311 (2) of Constitution of India.
A private respondent-Raja Bano who came to know about promotion of petitioner-Mir as Mukhi Savika made various representations to Minister, Commissioner and Director Vigilance and a full-fledged inquiry was conducted by Director Rural Development, who recommended to Commissioner Secretary for reconsideration and rescinding of order of promotion of petitioner and in inquiry it has been held that petitioner has deceived the Administrative Department by providing fictions /fake communication under fake signature of Director.
