Srinagar, July 11: The High Court has expressed serious concern over non-appearance of Government counsels before court and sought indulgence of Chief Secretary and Secretary Law to resolve the issue so that the justice is not hampered.
Justice Wasim Sadiq Nargal directed the CS and Secretary Law to take necessary steps in this regard.
order reads that it is the need of the hour that corrective measures are taken at the earliest by the Chief Secretary in consultation with the Law Secretary so that the dispensation of justice is not hampered.
Justice Nargal has put the hope and trust that the needful be done by both the parties without any further delay & the Court added that sincere endeavor to be made in this regard will be highly appreciable.
Previously the said court had shown concern with regard to the non-appearance of Government counsels to Secretary Law, Department of Law, Justice and Parliamentary Affairs, J&K, Achal Sethi, who was directed to appear in person and he had assured that an appropriate mechanism will be put in place to monitor the representation of all Government Advocates in the matters listed before the Court for the departments assigned to them.
But the court questioned that "In spite of assurance extended by Law Secretary, Department of Law Justice and Parliamentary Affairs, the position remains the same and the proper assistance as directed in the earlier order is still not rendered in all the cases by the Government Advocates, which is not in the interest of Government and hampering the administration of justice".
The court directed the Registry to convey the Order to the Chief Secretary, Union Territory of Jammu and Kashmir, as well as Law Secretary, Department of Law Justice and Parliamentary Affairs for its immediate compliance.
It is to mention here that Law Secretary has himself issued so many orders for time bound filing of replys in courts & presence of Govt Counsels followed by no unnecesarry adjournments but had he ever bothered to act on his non compliance?
Law Secretary can call the details of such cases where replys has not filed as per time fixed & act on non compliance for early disposal of cases, otherwise it is an proved issue of "DELAY IN JUSTICE IS DENIAL OF JUSTICE"
However, Govt can see the actions of sleeping by DC Office Jammu on filing replys in High Court in WP)C) No 1330 of 2023 , even on which DC Office Jammu has detected the scam of fraud permission & issuance of fraud documents by team of Revenuer Officers & thereafter cancelled the fraud permission & mutations & despite that not filing the reply & perusing the case properly for further actions on the said fraud raised questions.
