Departmental Proceedings after Retirement barred for Misconduct beyond 4 year Limit: High Court

Departmental Proceedings after Retirement barred for Misconduct beyond 4 year Limit: High Court

Patna, Oct 20: The High Court of Patna Single Bench of Justice Kumar Manish quashed departmental proceedings and an order deducting 75% of a retired government officer’s pension, holding that Rule 43(b) of the Bihar Pension Rules bars proceedings instituted after retirement concerning events more than four years old.

The dispute concerned alleged irregularities in installing high-mast lights and disbursing advances. Finding the proceedings barred by limitation, the Court directed restoration of full pension and payment of withheld retirement benefits with 6% annual interest within eight weeks, while declining a fresh inquiry.

The petitioner was appointed as a Deputy Collector in the Bihar Administrative Service in 1979 and retired from service on 31 December 2014 while serving as Director, Sainik Kalyan Nideshalaya, Patna, at the rank of Additional Secretary.
