Jammu, Oct 16: In O.A./1449/2026 titled MASARAT HUSSAIN Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:-
The applicant herein is aggrieved of the Govt. Order No. 432-JK-EDU of 2026 dated 13.10.2026 whereby respondent no. 04 has been assigned the charge of ZEO Bafliaz, District Poonch in place of the applicant, despite the fact that respondent no. 4 is junior to the applicant in the cadre seniority, as the applicant is figuring at serial no. 556 in the seniority list dated 13.03.2024, whereas the respondent no. 4 figures at serial no. 692.
Moreover, there is no order issued by the respondents, with regard to withdrawal of charge assigned to the applicant. Heard learned counsel for the applicant. Issue notice to the respondents, returnable on or before the next date of hearing.
Mr. Sudesh Magotra, learned Additional Advocate General appears and accepts reply on behalf of respondents. Respondents shall file reply within four weeks. List on 19.11.2026.
Meanwhile, as an interim measure, impugned Govt. Order No. 432-JK-EDU of 2026 dated 13.10.2026, shall remain stayed to the extent the respondent no. 4, namely, Shabir Hussain Shah has been assigned the charge of ZEO Baffliaz, and the applicant shall be permitted to perform his duties as ZEO Bufliaz, District Poonch.
Registry shall issue notice to private respondent no. 04, Sh. Shabir Hussain Shah.
