J&K: CAT rules that Transfer domain of  ADGP Armed  has no jurisdiction

Srinagar, Aug 21: The Central Administrative Tribunal Srinagar has quashed the order of detachment of an employee in J&K Armed Police issued by Additional Director General of Police (Armed) citing he has no jurisdiction to pass such an order.

The applicant-Mushtaq Ahmad Bhat working as Dental Hygienist called in question the legality and validity of Order issued by the Additional Director General of Police, Armed, J&K, whereby he was detached from Sub Police Hospital, Zewan and directed to report to his parent Battalion.

Bench of Ritu Tagor (Judl) quashed and set aside the order of detachment, the consequential relieving order as also the speaking.

The Bench, however, directed the DGP, J&K Police Headquarters to examine the question of the applicant's deployment afresh, strictly in accordance with the applicable departmental orders, and on its own merits, keeping in view the observations made in the instant order.
