JAMMU, Aug 5: The High Court has refused to quash a 2017 ACB's FIR registered against Forest Department officer Pankaj in an alleged disproportionate-assets case, holding that neither the absence of a preliminary enquiry nor delay in investigation was sufficient to terminate the criminal proceedings.
Justice M A Chowdhary dismissed the petition filed by Officer under Section 482 of the Code of Criminal Procedure seeking quashing of FIR No. 26/2017, registered at Police Station Anti-Corruption Bureau, formerly Vigilance Organisation Jammu, under Sections 5(1)(e) read with 5(2) of the J&K Prevention of Corruption Act.
The petitioner was serving as a Forester when the FIR was registered and is presently working as an In-charge Range Officer.
