Srinagar, Aug 03: Jammu and Kashmir Housing and Urban development department issued Order on Application over revocation and cancellation of building permission
Whereas, an application has been received from Sh. Farooq Ahmad Malik seeking revocation of Building Permission No. BP/ORDER/SHOPIAN/2026/333 dated 04.04.2026 issued by the Building Permission Issuing Authority (BPIA), Municipal Council Shopian, in favour of Sh. Abdul Rehman Malik, alleging that the said permission has been obtained by fraud, suppression of material facts and misrepresentation.
The Government order reads "And whereas, the application has been examined in terms of Clause 2.14.2 of the Jammu & Kashmir Unified Building Bye-Laws, 2021 (as amended vide S.O.304 dated 01.12.2025), which empowers the Competent Authority to revoke a building permit, subject to the procedure prescribed therein; And whereas, prima facie examination of the matter warrants initiation of proceedings under Clause 2.14.2 of the Unified Building Bye-Laws;
And whereas, if construction is allowed to continue during the pendency of the proceedings, the very purpose of the statutory power of revocation may be rendered ineffective and the proceedings may become infructuous;
Now, therefore, pending conclusion of the proceedings under Clause 2.14.2 of the Jammu & Kashmir Unified Building Bye-Laws, 2021, it is hereby ordered as under:
1. The Building Permission Issuing Authority (BPIA), Municipal Council Shopian, shall immediately initiate proceedings under Clause 2.14.2 by issuing a show-cause notice to the permit holder, affording an opportunity of hearing to all concerned parties and completing the proceedings expeditiously in accordance with law.
2. Pending final decision in the said proceedings, no further construction shall be carried out pursuant to Building Permission No. BP/ORDER/SHOPIAN/2026/333 dated 04.04.2026 until further orders.
3. The BPIA shall submit a speaking report, together with the complete building permission record and its recommendations, to the Competent Authority within a period of 30 days from the date of issuance of this order."
