Revenue Dept J&K issues clarification of Govt Order of year 2014

Jammu, June 14:Revenue Department of Jammu and Kashmir issued clarification of Government Order No Rev(NDK) 295of 2014 dated 12.12.2014.

The copy of Government Order No. 18 JK (Rev) of 2026, with Cross Town News reads "  Whereas one Shri Mukhtair Ahmad Shah s/o Late Mohammad Maqbool Shah R/o Rathpora has approached this Department with a representation dated 05.12.2025 enclosing therein a copy of communication No. DCS/PS/Misc/1171 dated 22.11.2014 from office of the Deputy Commissioner, Srinagar for seeking clarification of the Government Order No Rev(NDK) 295of 2014 dated 12.12.2014 regarding transfer of lease hold rights;

Whereas, the case was examined and the Deputy Commissioner, Srinagar was requested vide letter No.Rev/Lit/25/2026(7721220) dated 05.02.2026 to furnish the copy of said Government Order No Rev(NDK) 295of 2014 dated 12.12.2014 duly authenticated as the same was not found available in the records of the Revenue Department, however nothing has been received as yet.

Whereas, the petitioner has also filed the writ petition bearing WP(C) No.3413/2023 and the Hon'ble Court vide order dated 28.12.2023, has passed the following interim orders, operative portion of which is reproduced as under:-

               In the meanwhile, subject to the objections from the other side and till next date of hearing before the Bench, respondent No.4- Deputy Commissioner, Srinagar, shall accept the rent in respect of the leased out premises from the petitioner on the rates mentioned in the transfer order dated 22.12.2014, during the subsistence of the lease.

This shall, however, be without prejudice to the rights and contentions of the respondents.

Whereas, as per the statement of facts filed before the Hon'ble High Court by the office of Deputy Commissioner, Srinagar, it has been mentioned that the leasehold rights were renewed for a period of 19 years w.e.f. 2015 vide aforesaid Government order only in favour of the original lessees or their  Successor-interest.

No leasehold rights were conferred upon Mukhtar Ahmed Shah, who continues to occupy the land without authority. Now, therefore, keeping in view of the above facts, the following committee under the Chairperson of Special Secretary to the Government,(A) Revenue Department is hereby constituted comprising of the following officers to examine the varsity of the Government Order No Rev (NDK) 295 of 2014 dated 12.12.2014 1. Additional Secretary to the Government, Legal, Revenue -Member 2. Assistant Commissioner, Central, Divisional Commissioner, Kashmir - Member 3. Assistant Commissioner (Nazool), Srinagar 4. Assistant Legal Remembrancer, Revenue (AM)- Member Secretary 5. Under Secretary to the Government (A) - member The aforesaid Committee shall submit its report along with specific recommendations within One month from the date of issuance of the order.
