Jammu, March 17:CAT stayed J&K Govt's communication passed in contravention to CAT's Order related to promotions of Inspectors in LMD.
In M.A./303/2026 (JAMMU) [ STAY ] In O.A./47/2026, M.A./316/2026 titled ASIF MALIK Vs CONSUMER AFFAIRS after hearing CAT ordered as under:-
Miscellaneous Application No. 303 of 2026 has been filed by the applicants seeking stay of the letter no. FCSCA-Legal/75/2025-18(7700804) dated 09.03.2026 of Deputy Secretary to the Government, Department of Food, Civil Supplies and Consumer Affairs, Jammu/Srinagar.
A copy of the M.A. has already been furnished to the learned counsels for the respondents.
It is submitted by learned Sr. counsel for the applicants that aforesaid letter has been issued by the Department of Food, Civil Supplies and Consumer Affairs in contravention to the interim direction already passed by this Tribunal on 03.02.2026 in as much as rules for promotion to the post of Inspectors in the Legal Metrology Department in the U.T. of J&K, has not been amended.
Let reply to the M.A. be filed by the respondents by the next date with advance copy to learned counsel for the applicants.
List main O.A. on date already fixed i.e. 12.05.2026.
Meanwhile, subject to objections of the other side and till next date of hearing communication bearing no. FCSCA-Legal/75/2025-18(7700804) dated 09.03.2026 shall not be acted upon.
