Jammu, Jan 04: In M.A./1971/2025 (JAMMU)In O.A./2063/2025 titled RISHI KUMAR Vs POWER DEVELOPMENT DEPARTMENT after hearing CAT ordered as under;-
This MA has been filed by the applicants praying for modification/correction of Order dated 26.12.2025 passed in OA No. 61/2063/2025, whereby this Tribunal had observed and directed interalia:
4. Further, the concerned departments where the applicants are presently posted are directed to furnish APRs, Vigilance clearance alongwith work and conduct certificate pertaining to the applicants so that the applicants can be considered for their placement as In-charge Executive Engineers in their own pay and grade over and above the private respondents in view of the fact that the applicants are figuring higher in the seniority lists of Junior Engineers (Electric) Degree holders issued by the respondents read with tentative seniority list of Junior Engineers (Electric) Degree holders issued by the respondents from time to time. Considering the grounds stated therein in MA and prayer made by the applicants, instant MA is allowed. In view of the above, the relief No. (ii) sought for by the applicants as typed in Judgement dated 26.12.2025 passed in OA 61/2063/2025 after modification, will henceforth be read as follows:
"(ii) Direct the respondents 1 to 3 to direct the concerned Departments where the applicants are presently posted to furnish their APRs, Vigilance Clearance along with work and conduct certificate so that the applicants can be considered for their placement as In-charge Executive Engineers in their own pay and grade over and above the private respondents in view of the fact that the applicants are figuring higher by virtue of Orders dated 28.12.2006 and 29.12.2006 issued vide Order Nos. 239 PDD of 2006 and 240 PDD of 2006 which are already annexed with OA No. 61/2063/2025 as Annexure A3 and A4 read with revised tentative seniority list of Assistant Engineers (Electric) dated 10.04.2019 as Annexure 7."
Moreover, relevant para no. 4 of Judgement dated 26.12.2025 passed in OA 61/2063/2025 after modification, will henceforth be read as follows:
"4. Further, the concerned departments where the applicants are presently posted are directed to furnish APRs, Vigilance clearance along with work and conduct certificate pertaining to the applicants so that the applicants can be considered for their placement as In-charge Executive Engineers in their own pay and grade over and above the private respondents in view of the fact that the applicants are figuring higher in the seniority lists of Assistant Engineers (Electric) Degree holders issued by the respondents read with tentative seniority list of Assistant Engineers (Electric) Degree holders issued by the respondents from time to time."
Let the order passed hereinabove be treated as part and parcel of the Judgement/Order dated 26.12.2025 passed in OA 61/2063/2025.
