CAT stops salary of top boss of Education Dept for not conducting DPC since last 13 years

Jammu, Jan 04: In C.P./106/2024 (JAMMU) [ CONTEMPT ] In O.A./373/2023 With M.A./1394/2025  titled  KULDEEP SINGH KOTWAL Vs SCHOOL EDUCATION DEPARTMENT after hearing CAT ordered as under:-

The respondents despite grant of number of opportunities has not produced the minutes of meeting with regard to regularization/confirmation of the petitioners as Lecturer in the discipline of Geology.

It is submitted by learned counsel for the petitioner that for the last 13 years, the department has not conducted any DPC for regularization of the petitioners, who were working as Incharge Lecturers for so many years and during the pendency of this Contempt Petition, petitioners No. 4 & 7 have already retired.

It is further submitted by learned counsel that as per provisions of Jammu & Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, a Government department is required to conduct DPC twice a year. Be that as it may be.

The action of Respondent No. 1 department has resulted in denial of not only career progression, but also financial loss to the petitioners.

In these circumstances, we are left with no option but to attach the salary of Respondent No. 1 till further orders. The DDO concerned is directed to not release the salary of Respondent No. 1 and file an affidavit in this regard by the next date of hearing.

The respondents shall produce the minutes of meeting with regard to regularization/confirmation of the petitioners as Lecturer in the discipline of Geology by or on the next date of hearing. List on 06.02.2026.

Let a copy of this order be forwarded to Mr. Sudesh Magotra, learned A.A.G. for onward transmission to DDO concerned for compliance.
