DC Jammu issues Show Cause Notice to top Businessman over holding Weapon , as Gun License expired


JAMMU, Dec 19: DC Jammu Rakesh Minhas issued Show Cause Notice to top Businessman over holding Weapon , as Gun License stands expired.

This offence carry Jail term of 2 to 5 years , if Person is found guilty.

The Show cause notice copy with Cross Town News reads " Whereas, an Arms License has been issued in your favour as detailed , under the provisions of the Arms Act, 1959 and the Arms Rules, 2016, thereby authorising to possess a firearm;

Whereas, as per the NDAL-ALIS portal, one 0.32 Bore Revolver is endorsed on the said license and the validity of the said license has already expired on 14-08-2018, and the_ license has not been renewed thereafter;

. Whereas, as per Arms Rules, 2016, the said weapon is deemed to be illegal (in wake of expiry of the said license) and as such it was required to be deposited at the respective Police Station immediately."

The notice further reads Whereas, although the weapon ( deemed to be illegal in wake of expiry of the said license) was not publicly displayed, the said conduct ( of asking to bring Weapon , which was viral in Videos on Social media ) , prima facie reflects a grave risk of misuse of the licensed firearm and raises serious concerns 
and  has a direct bearing on public safety and maintenance of public peace, and is contrary to the conditions of the Arms Licence as well as the spirit of the Arms Act, 1959; 

Whereas, under Section 17(3)(a) and 17(3)(b) of the Arms Act, 1959, the Licensing Authority is empowered to suspend or cancel an Arms Licence if the licensee is found unfit to hold the licence or if such action is considered necessary in the interest of public peace and public safety;
